These Terms of Service ("Terms") govern your access to and use of the BookDirectly website, applications, and related services (collectively, the "Service") operated by BookDirectly ("we," "us," or "our"). By creating an account, subscribing, or using the Service, you agree to these Terms.
1. The Service
BookDirectly provides tools for vacation rental hosts to publish branded property websites, accept booking inquiries, collect electronic rental agreement signatures, process payments through Stripe, and manage related host workflows. We may modify features from time to time.
2. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Provide accurate account information and notify us promptly of unauthorized use.
3. Host responsibilities
If you use BookDirectly as a host, you are solely responsible for: - Your property listings, pricing, availability, house rules, and legal compliance with local short-term rental laws. - Guest communications, cancellations, refunds, and disputes, except as otherwise required by law. - Content you publish on your property site (including photos, descriptions, and policies). - Configuring Stripe Connect (or other payment settings we support) to receive guest payments where applicable.
You represent that you have the right to offer your properties for rent and to use guest personal information only for lawful booking-related purposes.
4. Subscriptions and platform fees
Host subscriptions are billed monthly through Stripe at the prices shown on our pricing page unless otherwise agreed in writing. Fees are non-refundable except where required by law or explicitly stated. You authorize us and Stripe to charge your payment method on a recurring basis until you cancel.
Failure to pay may result in suspension or termination of access.
5. Guest payments
Guest booking payments are processed by Stripe. When you connect a Stripe account, payouts and chargebacks are handled according to Stripe's terms and your Stripe account settings. BookDirectly is not a bank, money transmitter, or escrow agent. Processing fees charged by Stripe are separate from BookDirectly subscription fees.
6. Acceptable use
You agree not to: - Violate any law or third-party rights. - Upload malware, scrape the Service without permission, or attempt to bypass security. - Use the Service for fraudulent bookings, spam, or misleading listings. - Reverse engineer the Service except where permitted by law.
We may suspend or terminate access for violations.
7. Intellectual property
We own the Service, software, branding, and platform content. You retain ownership of your property content; you grant us a license to host, display, and process it as needed to operate the Service.
8. Third-party services
The Service integrates with third parties (including Stripe, email providers, and optional pricing or calendar tools). Your use of those services is subject to their terms. We are not responsible for third-party outages or acts.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION, SPECIFIC BOOKING VOLUME, OR LEGAL COMPLIANCE OF YOUR RENTAL OPERATION.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKDIRECTLY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
11. Indemnification
You will defend and indemnify BookDirectly against claims arising from your properties, guest relationships, content, or violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.
12. Termination
You may stop using the Service by canceling your subscription and closing your account where available. We may suspend or terminate access for breach, risk, non-payment, or discontinuation of the Service. Provisions that by nature should survive termination will survive.
13. Governing law and disputes
These Terms are governed by the laws of the United States and the State of Colorado, without regard to conflict-of-law rules, except where mandatory consumer protections apply in your jurisdiction. Disputes will be resolved in the state or federal courts located in Colorado, unless otherwise required by law.
14. Changes
We may update these Terms by posting a revised version on this page. Continued use after the effective date constitutes acceptance of the updated Terms where permitted by law.
